These Terms of Service (“Terms”) govern your access to and use of the Family Frame website (https://familyframe.co), the Uhale mobile application, and any related digital services provided by Family Frame (collectively, the “Services”). Please read these Terms carefully before using the Services.

By accessing or using the Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you may not use the Services.

1. Acceptance of Terms

These Terms form a binding agreement between you and Family Frame. By using the Services, you represent and warrant that you are at least 16 years of age and capable of forming a binding contract. If you use the Services on behalf of an organization, you confirm you have authority to accept these Terms for that organization.

The Services may change from time to time. We may add or remove features or suspend access without prior notice.

2. Privacy

Your privacy matters to us.

Our Privacy Policy (https://familyframe.co/privacy) explains how we collect, use, and protect personal information related to your orders and accounts.

It also describes how long we retain limited account metadata (such as login records) and how you can request deletion of that data at any time.

Important for app users: Photos uploaded through the Uhale app are stored locally on the frame and/or on your own connected devices. Family Frame does not store or access these photos on its servers.

3. Eligibility

The Services are intended for use by individuals 16 years of age or older. By using the Services you confirm you meet this requirement and will comply with all applicable laws.

4. Accounts and Registration

Uhale App Accounts

To use the Uhale app you must create a user account and provide accurate, current, and complete information. You are responsible for safeguarding your password and for all activities that occur under your account.

Notify us immediately at support@familyframe.co of any unauthorized use of your account.

Deleting the app does not delete your account; please contact support to request full account deletion.

Website Purchases

You may shop on familyframe.co without creating an account. Any information you provide at checkout must be accurate and complete.

5. User Conduct

You agree not to use the Services:

  • for any unlawful purpose or in violation of any applicable law;
  • to upload or distribute harmful, offensive, or infringing content;
  • to interfere with or disrupt the security, integrity, or performance of the Services;
  • to attempt unauthorized access to any systems or data.

6. Content and Intellectual Property

Except for photos you upload to your own frame through the Uhale app, all text, graphics, designs, trademarks, and other content made available through the Services are the property of Family Frame or our licensors.

You may not copy, distribute, or create derivative works from our content without written permission.

You retain ownership of any photos or content you personally upload through the app.

7. Third-Party Services

Certain features of the Uhale app are operated by a trusted third-party developer. While we partner with them, they remain independently responsible for their services. Links to other websites or services do not imply endorsement, and we are not responsible for their content, privacy policies, or practices.

8. Termination

We may suspend or terminate your access to the Services at any time if we believe you have violated these Terms. You may delete your Uhale account at any time by contacting support.

Survival: Sections relating to intellectual property, limitations of liability, indemnification, and dispute resolution will survive termination of these Terms.

9. Disclaimers

The Services are provided on an “as is” and “as available” basis without warranties of any kind. We do not warrant that the Services will be uninterrupted or error-free, or that any information will be accurate or secure.

10. Limitation of Liability

To the fullest extent permitted by law, Family Frame’s total liability for any claim related to your use of the Services will not exceed the amount you paid to Family Frame in the 12 months preceding the claim, except where prohibited by applicable law. We are not liable for any indirect, incidental, or consequential damages.

11. Governing Law and Binding Arbitration

These Terms and any disputes related to them are governed by the laws of the State of California, without regard to conflict-of-law principles.

Any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Services will be resolved exclusively by binding arbitration in California, administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules.

You and Family Frame waive any right to a jury trial or to participate in a class action.

If any part of this arbitration clause is found unenforceable, the rest will remain in effect.

12. Indemnification

You agree to indemnify and hold harmless Family Frame and its affiliates from any claims, damages, or expenses arising from your use of the Services or violation of these Terms.

13. Changes to These Terms

Family Frame may update these Terms from time to time. The most current version will be posted on https://familyframe.co/terms. Your continued use of the Services after changes are posted means you accept those changes.

By placing an order for products or services from the Family Frame website (https://familyframe.co

) you accept and agree to be bound by these Terms and Conditions of Sale (“Terms”). If you do not agree, do not purchase products or services from this site.

1. Scope and Acceptance

These Terms govern the purchase and sale of Family Frame products and services through https://familyframe.co

(the “Site”). Family Frame (“Family Frame,” “we,” “our,” or “us”) may update these Terms at any time without prior notice. The latest version will always be posted on the Site. Your continued use of the Site after a posted change constitutes acceptance of the updated Terms.

2. Website and Platform

The Site is operated by Family Frame and hosted on Shopify Inc.’s e-commerce platform. Your access to and use of the Site is also subject to our Website Terms of Service and Privacy Policy, which are incorporated by reference.

Links on the Site may lead to third-party websites. We are not responsible for the content, accuracy, or security of any third-party sites or services.

3. Orders and Acceptance

Each order you place is an offer to purchase under these Terms. We may accept or reject any order in our sole discretion. After we receive your order, we will email you a confirmation. A binding sales contract forms only when you receive that confirmation.

You may cancel your order within 30 minutes of receiving the confirmation email using our self-cancellation tool. After that, our standard return and refund policy applies.

4. Prices, Price Changes, and Payment

All prices shown on the Site are in U.S. dollars and may change without notice. The price charged is the price in effect when your order is placed and will appear in your confirmation email.

Obvious pricing errors (for example, a $0.01 glitch) are not binding; we reserve the right to cancel any order affected by such errors.

Prices exclude taxes and shipping, which will be added at checkout. Payment must be received before shipment. We accept major credit cards and other methods listed at checkout.

5. Shipping, Delivery, and Risk of Loss

Family Frame arranges shipment of products to you. Shipping and delivery dates are estimates and cannot be guaranteed.

We primarily ship within the United States but fulfill international orders. Customers are responsible for customs duties and import taxes.

We are not liable for delays or losses caused by customs inspections, local import rules, or other factors beyond our control.

Title and risk of loss pass to you upon delivery to the address provided.

Consumers outside the United States may have additional rights under their local laws, and those rights are not affected by these Terms.

6. Product Information and Availability

We strive to display our products accurately, but cannot guarantee perfect color or detail on every screen. All products are subject to availability and we may limit quantities or discontinue items at any time.

7. Returns and Refunds

Family Frame accepts returns within 120 days of delivery for a full refund to the original form of payment.

Products must be returned in their original condition and packaging, and Family Frame will pay for return shipping when you use our authorized return label.

8. Two-Year Limited Warranty

Family Frame provides a two-year (2) limited warranty covering manufacturing defects only.

This warranty does not cover damage from accidents, misuse, neglect, normal wear and tear, or unauthorized modifications.

Remedies under this warranty are limited to, at our discretion:

  • Replacement with an equivalent product, or

  • Refund of the purchase price.

Family Frame pays for return shipping on warranty claims when you use our authorized return label.

We may require proof of purchase and may request that you return or responsibly dispose of the defective product.

9. Limitation of Liability

To the fullest extent permitted by law, Family Frame’s total liability for any claim related to your purchase will not exceed the amount you paid for the product, except where prohibited by applicable law (for example, claims involving personal injury or property damage).

We are not liable for any indirect, incidental, or consequential damages.

10. Goods Not for Resale or Export

Products purchased from Family Frame are for personal or household use only and not for resale or export. You agree to comply with all applicable export and import laws and regulations.

11. Intellectual Property

All intellectual property rights in the products, the Site, and related materials remain the sole property of Family Frame or its licensors. No right, title, or interest is transferred to you except as expressly set forth in these Terms.

12. Privacy and Data

It also describes your rights to request deletion of personal data and images and to control how long your data is retained, consistent with U.S. and international privacy laws such as the CCPA and GDPR.

13. Force Majeure

Family Frame is not liable for delays or failures caused by events beyond our reasonable control, including natural disasters, acts of government, labor disputes, or internet service disruptions.

14. Governing Law

These Terms and any disputes related to them are governed by the laws of the State of California, without regard to conflict-of-law rules.

15. Dispute Resolution and Binding Arbitration

You and Family Frame agree to resolve any dispute, claim, or controversy arising out of or relating to these Terms or your purchase exclusively by binding arbitration in the State of California.

This means:

No jury trial and no class actions.

The arbitration will be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules.

The arbitrator’s decision is final and can be enforced in any court of competent jurisdiction.

If any part of this arbitration clause is found unenforceable, the remaining parts will remain in effect.

16. Assignment

You may not assign or transfer your rights or obligations under these Terms without our written consent.

17. No Waiver

Our failure to enforce any right or provision of these Terms does not waive our right to enforce it later.

18. No Third-Party Beneficiaries

These Terms create no rights for any third party.

We may send legal notices to the email address you provide at checkout or post notices on the Site.

20. Severability

21. Entire Agreement

Your order confirmation, these Terms, the Website Terms of Service, our Privacy Policy, and our Limited Warranty constitute the full agreement between you and Family Frame regarding your purchase.

What We Do

What We Don’t Do

  • We do not store or access your photos on any server. All photos sent to your Family Frame stay local to the Uhale app and your frame hardware.
  • We do not sell personal data for monetary value.
  • We do not use your photos for advertising.

  • Name, email, shipping/billing address, and payment details
  • Order history and related support communications

From the Uhale App

  • Email and password to create an account
  • Device information (e.g., model, operating system)
  • Minimal login records for security and troubleshooting

Automatically

  • Standard website analytics, including Google Analytics and Meta (Facebook) Pixel, which use cookies or similar technologies to understand traffic and measure advertising effectiveness.

  • Provide and maintain the Uhale app and our Services
  • Communicate about orders, warranty, and updates
  • Send optional marketing emails (you can unsubscribe anytime)
  • Analyze website traffic and measure ad performance

6. Sharing of Information

We share data only as needed to operate and improve our Services:

  • Service Providers such as Shopify (e-commerce), shipping carriers, payment processors, and our trusted third-party developer operating certain Uhale app features
  • Analytics and Advertising Partners (Google Analytics and Meta Pixel) for site performance and advertising metrics
  • Legal or safety disclosures when required by law or to protect our rights

We never sell your personal data.

7. Your Rights

Family Frame complies with privacy laws including California’s CCPA/CPRA, and we apply these rights broadly for all U.S. customers:

11. Third-Party Developer (Uhale App)

Certain features of the Uhale app are operated by a trusted third-party developer. While we partner closely with this developer, they remain independently responsible for their own services.

The developer is contractually required to maintain appropriate privacy and security measures consistent with this Policy.

Nothing in this policy limits any rights you may have under applicable privacy laws in your country of residence.

12. Marketing Emails

If you subscribe to marketing emails, we’ll send occasional promotions or updates.

Return Policy

We stand behind the quality of every Family Frame. If something isn’t right, we’re here to help.

1. Eligibility

  • 120-Day Window – You may request a return within 120 days of the original purchase date.
  • Reason for Return – Returns are accepted only for manufacturing or defective issues, even if the defect resulted from an accidental break by the customer.
  • Proof of Purchase – A valid order number or receipt is required.
  • Original Packaging – The frame must be returned in its original box with all accessories and protective materials.

2. How to Request a Return

  2. Approval – We review each request and respond within 7 days with instructions and a prepaid shipping label if approved.

3. Refunds & Replacements

  • Once we receive and inspect the return, we will either issue a full refund to the original payment method or send a replacement frame, based on your preference.
  • We cover all return shipping costs for approved returns.

4. Important Notes

  • Items returned without prior approval, without original packaging, or without proof of purchase may not qualify for a refund or replacement.

Shipping Policy

We aim to deliver every Family Frame quickly and safely, wherever your loved ones live.

1. Processing Time

  • Order Confirmation – You’ll receive an email confirmation as soon as your order is placed.
  • Processing & Packing – Orders are typically packed and leave our facility within 1–3 business days.
  • If we experience a high volume of orders, processing may take slightly longer. We will notify you of any significant delays.

2. Shipping Methods & Delivery Times

  • United States (Primary Market) – Standard shipping usually arrives within 3–7 business days after dispatch.
  • International Orders – Delivery times vary by destination, typically 7–21 business days.
  • All orders include tracking information so you can follow your shipment from our door to yours.

3. Shipping Costs

  • Family Frame provides free standard shipping on all orders delivered within the United States.

    For orders shipped outside the United States, a flat shipping fee of $10 (USD) applies per order, regardless of destination. Any customs duties, taxes, or import fees charged by the destination country remain the responsibility of the recipient.

4. Customs, Duties & Taxes

  • International customers are responsible for any customs duties, VAT, or import taxes required by their country.
  • Customs inspections or local regulations may occasionally cause delivery delays beyond our control.

5. Damaged Packages

If your package arrives damaged, please:

  1. Take clear photos of the outer box and the product.
  2. Contact support@familyframe.co within 7 days of delivery so we can arrange a replacement or refund.

6. Address Accuracy

Please double-check your shipping address before completing checkout. We are not responsible for delays or losses caused by incorrect or incomplete addresses.

Warranty

Effective Date: 8/27/25

Family Frame provides a two (2) year limited warranty (“Warranty”) on all new digital frames purchased directly from familyframe.co. This Warranty is our promise that each frame will be free from manufacturing defects in materials and workmanship for two years from the date of purchase.

What Is Covered

  • Defects in materials or workmanship that prevent normal operation of the frame
  • Electrical or structural failures caused by a manufacturing flaw

What Is Not Covered

  • Accidental damage, misuse, neglect, improper installation, or modifications
  • Normal wear and tear (including cosmetic scratches, fading, or dents)
  • Damage caused by power surges, weather, or natural disasters
  • Any loss or damage to photos or data

Warranty Service

If you believe your frame qualifies for service:

  1. Contact us at support@familyframe.co with proof of purchase, a description of the defect, and photos or video if possible.
  2. Our team will review the claim. If approved, we will repair or replace the defective product at no charge.
  3. Family Frame will cover all shipping costs for approved warranty claims within the United States and international locations.

Exclusive Remedy

Repair or replacement of the defective product is your sole and exclusive remedy under this Warranty. We reserve the right to use new, refurbished, or functionally equivalent parts.

Limitations

This Warranty applies only to the original purchaser and only to products purchased directly from familyframe.co.

Except where prohibited by law, Family Frame’s liability is limited to the original purchase price of the product. Some jurisdictions do not allow limitations on implied warranties or on incidental or consequential damages, so these limits may not apply to you.
